Terms of Service

By accessing or using PinBoostr ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use the Service.

These Terms constitute a legally binding agreement between you and PinBoostr ("we," "us," or "our"). Your continued use of the Service constitutes ongoing acceptance of any updates to these Terms.

PinBoostr is a software-as-a-service (SaaS) platform that provides Pinterest scheduling, analytics, AI pin creation, and keyword research tools. The Service is delivered entirely over the internet (digital delivery). We operate as an independent third-party tool using Pinterest's official API and are not affiliated with or endorsed by Pinterest, Inc.

• You must provide accurate, current, and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• You must be at least 18 years of age (or the age of majority in your jurisdiction) to purchase a paid subscription. Users aged 13–17 may use only the Free plan with parental consent.
• One person may not maintain more than one free account.
• You agree to notify us immediately at support@pinboostr.com of any unauthorized use of your account.

By connecting your Pinterest account to PinBoostr, you authorize us to access and act on your behalf via Pinterest's official API. You agree to:

• Comply with Pinterest's Terms of Service and Community Guidelines at all times.
• Not use PinBoostr to post spam, misleading content, or content that violates Pinterest's policies.
• Revoke our API access at any time through your Pinterest account settings.

We are not responsible for any changes Pinterest makes to its API, which may affect Service functionality without notice.

All purchases of paid subscriptions on PinBoostr are processed by Paddle.com Market Limited ("Paddle"), a third-party payment processor that acts as the Merchant of Record for all transactions. This means:

• The legal seller on your payment statement is Paddle.com, not PinBoostr directly.
• Paddle collects payment, handles applicable sales tax and VAT on our behalf, and issues receipts.
• Your payment information (card details, billing address) is collected and stored by Paddle — PinBoostr does not store your payment credentials.
• By completing a purchase you also agree to Paddle's Terms of Service and Paddle's Privacy Policy.
• For payment-related disputes, billing enquiries, or receipt requests, you may contact Paddle directly at paddle.com/support.

• Paid subscriptions are billed in advance on a recurring cycle (monthly, every 6 months, annually, or another period as displayed at checkout), starting from the date of purchase.
• Subscription fees are charged automatically at each renewal date using the payment method on file with Paddle.
• We reserve the right to change subscription pricing. We will provide at least 30 days' advance notice of any price changes before they take effect on your renewal date.
• Failure to pay may result in downgrade to the Free plan or suspension of your account.
• An active paid subscription is required for scheduled pins to be posted. Pins scheduled beyond your subscription expiry date will not be published. You must maintain an active subscription for the full scheduling period to ensure all pins are posted.
• You can view, update, or cancel your subscription at any time via the Paddle customer portal accessible from your PinBoostr account dashboard.

Our refund terms are governed by our dedicated Refund Policy, which forms part of these Terms. Key points:

• Subscriptions: All subscription purchases are eligible for a full refund within 14 days of the transaction date, no questions asked and no conditions.
• In-App Credits: Credits purchased to power AI Image Generation (a planned future feature) are also covered by the same 14-day full refund guarantee.
• EU / EEA / UK consumers: Our 14-day full refund guarantee meets and exceeds the statutory right of withdrawal under EU Directive 2011/83/EU and equivalent UK legislation.

The Free plan includes the following limits:

• 30 scheduled pins in total (one-time allowance — no monthly renewal). Once the limit is reached, a paid plan is required to continue.
• 1 connected Pinterest account.
• 1 connected website.
• 2 active campaigns at a time.

We reserve the right to modify Free plan limits at any time without notice.

You agree NOT to use PinBoostr to:

• Post spam, duplicate content, or engage in inauthentic engagement tactics.
• Violate any applicable law or regulation, including consumer protection, data protection, and intellectual property laws.
• Attempt to gain unauthorized access to the Service or its underlying infrastructure.
• Reverse-engineer, decompile, or create derivative works from the Service.
• Resell or sublicense access to the Service without our prior written permission.

PinBoostr and its original content, features, and functionality are owned by PinBoostr and are protected by copyright, trademark, and other intellectual property laws. You retain full ownership of all content you create and post through the Service. By using the Service you do not acquire any ownership rights in our software or branding.

Our collection and use of personal data is described in our Privacy Policy, which forms part of these Terms. By using the Service you agree to our Privacy Policy.

When you make a purchase, certain data (such as your name, email address, and billing address) is shared with Paddle as required for payment processing and tax compliance. Paddle's handling of this data is governed by Paddle's Privacy Policy.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee any specific results (traffic increases, follower growth, impressions, etc.). Pinterest may change its API or policies at any time, which may affect Service functionality.

To the maximum extent permitted by applicable law, PinBoostr and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to loss of revenue, data, or business opportunity, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising under these Terms shall not exceed the amount you paid to us (via Paddle) in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded by law.

You may cancel your subscription at any time through the Paddle customer portal in your dashboard. Cancellation takes effect at the end of your current billing period — you retain access until then.

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if required by law. Upon termination, your right to use the Service ceases immediately and your data may be deleted after a reasonable retention period.

These Terms are governed by the laws of the jurisdiction in which PinBoostr operates, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration or the competent courts of our operating jurisdiction.

If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice in the Service at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
